Ouna operates this website and related services, including Ouna community events, run registrations, communications, and, where available, products and online shopping services (collectively, the “Services”).

Ouna uses Shopify to operate portions of the Services, including our website, online forms, customer records, and ecommerce features.

This Privacy Policy explains how Ouna collects, uses, discloses, stores, and otherwise handles personal information when you visit or use our website, register for an Ouna event, communicate with us, subscribe to our communications, purchase a product or service, or otherwise interact with Ouna.

By using the Services, you acknowledge that you have read and understood this Privacy Policy.

Personal Information We Collect

“Personal information” means information that identifies you or can reasonably be linked to you. It does not include information that has been anonymized or de-identified so that it can no longer reasonably identify you.

Depending on how you interact with Ouna, we may collect the following categories of personal information:

  • Contact information, including your name, email address, phone number, billing address, shipping address, and other contact details.
  • Event and run registration information, including your running level, Instagram handle if voluntarily provided, confirmation that you are 19 years of age or older, and other information you provide when registering for an Ouna event.
  • Waiver and participation records, including your full legal name entered as an electronic signature, confirmation that you have read and accepted the applicable Ouna waiver or participation terms, and the date and time associated with your registration or acceptance.
  • Marketing preferences, including whether you have chosen to receive emails about Ouna runs, events, releases, products, or other news.
  • Account information, where applicable, including usernames, account preferences, settings, and related account information.
  • Transaction information, where applicable, including products or services viewed, purchased, returned, exchanged, or cancelled.
  • Payment information, where applicable. Payment information may be collected and processed by Shopify and payment service providers rather than directly by Ouna.
  • Communications with us, including information you provide when contacting Ouna, making an inquiry, requesting support, or otherwise communicating with us.
  • Device and technical information, including your IP address, browser type, device information, network information, and similar identifiers.
  • Website usage information, including information about how and when you browse, navigate, or interact with our website and Services.
  • Other information you voluntarily provide to us.

We aim to collect only personal information that is reasonably necessary for the purposes described in this Privacy Policy.

  • Directly from you, including when you register for an Ouna event, complete a form, subscribe to communications, contact us, create an account, or purchase a product or service.
  • Automatically through our website, including through cookies and similar technologies.
  • From service providers, including Shopify and other providers that support our website, forms, communications, analytics, payments, or other business operations.
  • From partners or other third parties, where permitted by law or where you have authorized the disclosure.

How We Use Personal Information

We may use personal information for the following purposes.

Ouna Events and Run Registration

We may use personal information to:

  • register and manage participants for Ouna runs and other events;
  • confirm participant eligibility, including the applicable 19+ age requirement;
  • communicate event dates, locations, schedules, changes, cancellations, safety information, and other event-related information;
  • organize participant lists and event administration;
  • maintain waiver, electronic signature, consent, and participation records;
  • respond to incidents or safety concerns;
  • communicate with participants before or after an event; and
  • maintain records reasonably required for legal, insurance, safety, or dispute-resolution purposes.

Providing and Improving the Services

We may use personal information to operate, provide, maintain, customize, and improve our website and Services.

Where Ouna offers products or ecommerce services, this may include processing orders and payments, arranging delivery, handling returns or exchanges, maintaining customer accounts, and providing customer support.

Communications

We may use your contact information to communicate with you regarding:

  • an event you registered for;
  • changes to a run or event;
  • your account, transaction, inquiry, or request;
  • safety or administrative matters; and
  • other non-promotional communications reasonably necessary to provide the Services.

These operational communications are separate from optional marketing communications.

Marketing

Where you have provided consent, we may send you marketing emails about Ouna runs, events, community activities, partnerships, products, releases, and other Ouna news.

Registering for an Ouna event does not require you to consent to marketing emails.

You may unsubscribe from marketing communications at any time using the unsubscribe link in an email or by contacting us.

We currently do not require SMS or WhatsApp marketing consent as part of Ouna Run registration.

Security and Fraud Prevention

We may use personal information to:

  • protect our website, participants, customers, and business;
  • authenticate accounts;
  • prevent or investigate fraud, abuse, illegal activity, malicious activity, or security incidents; and
  • protect the safety and rights of Ouna, our participants, customers, and others.

Legal and Business Purposes

We may use personal information where reasonably necessary to:

  • comply with applicable laws or lawful legal processes;
  • establish, exercise, or defend legal rights;
  • investigate actual or potential violations of our terms, policies, or agreements;

Withdrawal of marketing consent does not affect necessary operational communications, such as communications relating to an event for which you have registered.

Age and Ouna Run Events

Ouna Run events are intended only for participants who are 19 years of age or older.

Our run registration process requires participants to confirm that they are at least 19 years old.

We do not knowingly accept registrations for Ouna Run events from individuals under 19.

If we learn that personal information was submitted in connection with an Ouna Run registration for a person under 19, please contact us at contact@ouna.ca.

Waivers and Electronic Acceptance

Participation in certain Ouna activities may require you to review and accept a separate waiver, release, assumption-of-risk agreement, participation agreement, or other event terms.

Where required, we may record information such as:

  • your confirmation that you reviewed and accepted the applicable agreement;
  • your full legal name entered as an electronic signature;
  • your age-eligibility confirmation;
  • the version of the applicable agreement;
  • your registration information; and
  • the date and time of submission or acceptance.

These records may be retained for legal, insurance, risk-management, safety, and dispute-resolution purposes.

The Ouna Run Waiver & Release is separate from this Privacy Policy.

How We Disclose Personal Information

We may disclose personal information where reasonably necessary to operate Ouna and provide the Services.

This may include disclosure to:

  • Shopify, which hosts and supports portions of our website, registration forms, customer information, ecommerce functions, and related Services;
  • service providers that assist with technology, website hosting, email, analytics, cloud storage, customer support, event administration, payment processing, fulfillment, shipping, security, or other business functions;
  • professional advisers such as lawyers, insurers, accountants, or other advisers where reasonably necessary;
  • event partners, venues, contractors, coaches, or service providers where information is reasonably required to operate an event;
  • government, regulatory, court, law-enforcement, or other authorities where disclosure is permitted or required by law;
  • parties involved in a business transaction, such as a financing, restructuring, merger, sale, acquisition, or similar transaction; and
  • other third parties where you direct us or provide consent.

We do not disclose personal information merely because it may be commercially useful to another party.

Shopify

Our website and portions of our Services are powered by Shopify.

Shopify collects and processes certain personal information relating to your access to and use of the Services in order to provide its services to Ouna and users of Shopify-powered websites.

Information provided through our website may be processed by Shopify or its service providers in countries other than Canada.

Shopify may also process certain information independently in accordance with its own privacy practices.

  • whether you have registered for or participated in an Ouna event;

In particular, Ouna may retain event registration, waiver acceptance, electronic signature, age confirmation, and participation records for as long as reasonably necessary for legal, insurance, risk-management, safety, or dispute-resolution purposes.

When personal information is no longer reasonably required, we will securely delete, destroy, or de-identify it as required by applicable law.

BC’s Personal Information Protection Act requires organizations to destroy documents containing personal information, or make the information anonymous, once the purpose is no longer being served and retention is no longer necessary for legal or business purposes.

Access and Correction

Subject to applicable law, you may request access to personal information Ouna holds about you and request correction of information you believe is inaccurate or incomplete.

Depending on where you live, additional privacy rights may apply.

Such rights may include rights relating to access, correction, deletion, portability, restriction, objection, or withdrawal of consent.

These rights are not absolute and may be subject to legal exceptions, including where Ouna is required or permitted to retain information for legal, insurance, contractual, security, or other legitimate purposes.

Marketing Preferences

You may unsubscribe from Ouna marketing emails at any time using the unsubscribe link included in our marketing communications.

If you unsubscribe from marketing communications, we may still send you non-promotional communications reasonably necessary to:

  • administer an event for which you registered;
  • respond to an inquiry;
  • provide a service;
  • complete a transaction;
  • communicate safety or administrative information; or
  • comply with legal obligations.

International Processing

Some of our service providers, including Shopify, may process or store personal information outside Canada.

As a result, personal information may be subject to the laws of the jurisdiction in which it is processed and may be accessible to courts, law-enforcement agencies, or other authorities in those jurisdictions in accordance with applicable law.

Where required, appropriate safeguards will be used for international transfers of personal information.

Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to:

  • our Services;

  • our technology or service providers;

BC’s Personal Information Protection Act requires organizations to designate an individual responsible for privacy compliance and make the position/title and contact information publicly available.
